KidsHQ SuperMeals Terms of Sale
Use of Website and Sale of Products Generally
KidsHQ SuperMeals is owned by The Village Zquare Trust (in these terms of sale referred to as “we”, “us” and “our”) which is a charitable trust registered under the Charitable Trusts Act 1957.
The use of this website to purchase KidsHQ SuperMeals is subject to the following terms of sale and to the requirements and limitations contained in the online Order Form.
We reserve the right at any time and for whatever reason to:
- vary these terms of sale,
- decline any application for registration by a potential customer or suspend or cancel a registration,
- refuse to accept orders and to cancel any orders,
- make changes to the menus comprising our products, and
- make changes to the information provided on our website.
Ordering Products
You are liable for every order that you make using your login.
Without our prior written approval in each case, you shall not order our products for the purpose of resale.
The prices of Kids HQ Super Meals listed on our website are expressed in New Zealand dollars and are GST inclusive. There is an additional charge for delivery.
We will email you an order statement to confirm your purchase.
We reserve the right to change the prices at any time.
Payment
Payment for products shall be made at the time of ordering using one of the credit or debit cards listed in the online order form. Your order is only accepted (subject to our rights stated above) when you receive from us both an order confirmation and payment confirmation.
Your credit or debit card will record the payment by reference to the words “KidsHQ SuperMeals”. Your card number will not be stored once payment has been processed.
Delivery
Delivery of our products will be made in accordance with the conditions set out in our delivery information pages. If the delivery address that you select is not within our delivery areas, the sale cannot be processed unless you elect to collect your order from one of our direct sales locations.
We use our best endeavours to complete delivery at the time nominated but we shall not be liable for any failure to deliver that is outside our control. However, if we become aware of a substantial delay in delivery, we will take all reasonable steps to contact you to arrange an acceptable alternative delivery date. If that timeframe for delivery is not acceptable, you may decline to accept the order and, in that situation, we will credit you with the cost of your order.
Where the delivery date falls on a public holiday, we reserve the right to deliver on the next working day and in that case, we will endeavour to notify you at least 36 hours before that date.
Delivery may be made by an agent engaged by us who shall be entitled to assume that any person present at the delivery address that you have supplied is entitled to accept delivery of the products.
You must ensure that the delivery address is easily accessible by our agent and presents no health or safety issues. If, acting reasonably, our agent declines to make delivery, you will be contacted to make alternative arrangements.
Failing acceptable alternative arrangements being made, we may decline to complete delivery but you will remain liable for payment in full as if you had received your order.
If there is no person at the delivery address or you or any other person at the delivery address refuses to accept delivery, the products will be left at the delivery address and delivery will be deemed to have taken place.
If we incur any additional costs as a result of any difficulty in effecting delivery of the products, we reserve the right to charge you for those costs. However, we will take all reasonable steps to contact you if any problem arises in effecting delivery.
Product Quality and Description
It is our intention to give total customer satisfaction through the products we offer. KidsHQ SuperMeals should be sold to you in perfect condition.
If, at the time of delivery of the products to you, you consider that they are damaged or otherwise compromised, please contact us immediately. If we accept your concern, we will either replace the products or provide a refund. However, if you do not contact us within 24 hours of delivery, you will have been deemed to have accepted the delivery unless we agree otherwise.
If the products delivered are not of the same description as those ordered by you, you may elect to keep them or reject them as long as they are in their delivered state and have not been tampered with. However, if you do not contact us within 24 hours of delivery, you will be deemed to have accepted the delivery unless we agree otherwise.
In all other cases, ownership, responsibility and risk in the products shall pass to you on delivery to the delivery address.
Warranties
We give no warranty as to the suitability of any of our products for the consumption by any particular person.
KidsHQ SuperMeals are not designed to cater for any specific or cultural dietary requirements or restrictions.
It is your responsibility to ensure that the products are handled correctly and that the instructions on the products are followed.
We have endeavoured to ensure that the information provided on this website is free from error. However, we do not warrant its accuracy, adequacy or completeness and we shall not be responsible or liable for any error in, or omission from, the information provided on our website.
Liability
Our liability to you whether in contract, tort or otherwise for any loss, damage or injury arising directly or indirectly from any defect in, or non-compliance of, a product or any other breach by us of our obligations stated in these terms of sale shall not in any event exceed an amount equivalent to the price of the relevant product purchased by you.
Intellectual Property
All right, title and interest in all intellectual property in relation to our website and its contents is owned by us and at all times shall remain our exclusive property, our license or is and providers of any other products and services accessible through the website, and is protected by New Zealand and international law.
Governing Law
The laws of New Zealand govern the use of our website and these terms of sale.
